POLICIES & PROCEDURES

GENERAL POLICIES

  1. All dealers must be licensed with their state and registered at this auction before doing business.  Dealers should register before sale day to expedite registration.

  2. DEALERS ONLY- no retail customers are allowed.

  3. No one under the ago of 16 will be admitted.

  4. All arbitrations must be noted on sale day.

  5. All titles submitted by sellers must be in sellers company name.  Each unit must be paid for by individual business checks or drafts.  Dealers checks must be printed to match registration card. 

  6. All cars purchased or sold on auction premises must be paid for through the front office.  No private transactions.

  7. Buyer is responsible for verifying public VIN plate, model, year and mileage reading on all purchases before leaving sale.  No vehicle will be offered for sale without public VIN plate.  Seller is responsible to insure a vehicle is properly offered for sale at the block.

  8. It is the sellers obligation to correct any errors made by the auction as to announced conditions, as well as any errors that may appear on the windshield of vehicle.  It is the buyers obligation to watch lights and listen to announced conditions.

  9. All police cars, taxi cabs, fire cars, flood cars, clips, salvage cars, reconstructed cars, motorcycles and boats and trailers must be sold under the red light and announced as such.

  10. The auction does not guarantee the year of any house trailer, motor home, boat motor, antique trucks, dun buggy, kit car or motorcycle.  Satisfy yourself before your settlement, as the auction will not become involved in any subsequent dispute.  Writing on windshield by auction is for your convenience only and will not be considered arbitration.

  11. All cars must have gate pass before leaving premises.

  12. "IF SALES" are not binding to the buyer or seller until the sale has been consummated.

  13. Outside sales are strictly between the buyer and seller and are not binding on either side until the sale is consummated.  The auction will not become involved in any arbitration procedures or be responsible for any defects not sold under the hammer.

  14. Any purchase other than on the block is "AS-IS".

  15. The auction does not guarantee any warranty books or plates.

  16. Any changes on the dealer registration form such as ownership authorized representatives, Bank, etc., must be immediately recorded with Auction by letter signed by the owner.  Dealer Registration will request updates.

  17. Deanco Auto Auction will not offer for sale vehicles not originally manufactured for sale in the United States (grey market cars).

  18. No foreign titles accepted.

  19. The auction reserves the right void any transaction.

  20. The Auction will require a seller to take back any vehicles with a documented odometer rollback problem.

  21. Cars are left on the auction premises at owner's request and risk.  The auction shall not be held responsible for loss or damage, even though the keys and car may be placed in the auction's custody for services which are made available to customers on these terms.

  22. Diesel conversions and units with catalytic converters removed and/or gas tank neck punched must be announced.

  23. Sellers: All vehicles must have enough fuel to run through the lanes and a reasonable test drive.  Any unit requiring fuel will be charged $10.

  24. No vehicle with odometer reading only kilometers will be registered for sale.

  25. Federal and State statures apply:  Vehicles 10 years old or older are exempt from odometer announcement requirements.

  26. The auction will not be responsible for administrative errors.

  27. Clip cars and flood damaged cars must be announced.  Discovery of unannounced clips or flood damage must be reported within 7 days of purchase and must be documented.

  28. All units leaving auction will be searched at exit gate to include trunk and cargo areas.

  29. Auction reserves the right to refuse service to anyone.

  30. Buyers should check vehicles to make sure odometer is working.  Discovery of inoperable odometers must be reported to the auction title clerk day of sale.

  31. Auction policies are subject to change without notice. Watch our Market Report and weekly flyer for changes.

  32. The auction is not liable for any state tax or ad valorem tax.

  33. Any vehicle misrepresented by announcement, advertisement, logo decal, nameplate, etc., is arbitratable day of sale ONLY, except " AS-IS" vehicles.

  34. Persons found tampering with or removing equipment from vehicles will be subject to suspension from the sale and WILL BE PROSECUTED.    Dealers will be held responsible for the actions of their employees.

  35. The Auction accepts no responsibility for collisions or paint damage when Auction staff is not involved.

ODOMETERS

Broken odometers, True Mileage Unknown and miles in excess of mechanical limits are specific conditions and must be announced as separate condition at the time of sale.  Broken odometers must be reported to auction clerk day of sale.   However, if vehicle is announced on block as actual miles, unit has no time limit to be returned.  Any dealer, guilty or innocent, who sells a car where odometer tampering can be confirmed will be required to buy back the unit, to include transportation and reasonable expenses.  Odometers must read mileage, not kilometers, in order to be registered for sale.  Vehicles ten years or older are mileage exempt.

TITLES

  1. If a vehicle has had a previous salvage title and has been repaired in accordance with state law to issue a clear title, this must be announced at the time of the sale and sold under the red light.  Bonded titles must be announced.

  2. Titles for motor homes, conversion vans, motorcycles, trailers and boats must be approved before sale.

  3. Manufacture/ Lemon law buy backs must be announced by the seller

  4. Certificate of Origin (MSO) must be announced.

  5. Seller must announce year of chassis and year of units on all motor homes and dune buggies.

  6. Failure to announce "NO TITLE PRESENT" (blue light) at the block will permit the buyer to void the transaction on sale day only. 

BUYERS

Examine all cars before bidding and be familiar with all announced conditions of the units.  In order for a unit to be taken on the road for a test drive, the owner must pre-approve the test drive through the main office.  Deanco Auto Auction is not liable for any incident that may occur during the test drive.  Do not test drive unit n lot as it may endanger other dealers and employees.  Examine the serial number plate, model year and the mileage reading before leaving the sale.  You must pay for each car with a separate check or draft.  Cars left on property must have keys left in them.  All vehicles must be paid for on sale day by cash, check or draft.  Methods of payment are determined by auction management.  All customers are assigned auction governed credit limitations.  Failure to hear announced conditions from the auction block does not constitute reason to refuse to pay for units.  All sales are recorded by video and audio and will be used to determine questionable situations.  All returned checks will be accessed a $100.00 fee for each check returned.  Under NO circumstances shall a dealer stop payment on a check or refuse to honor a draft.  Buyers, check odometer/speedometer for proper operation the day of Sale.  Tomorrow is too late. If a buyer calls to return a vehicle for no negotiable title, and the Auction has received or mailed the title, Buyer must keep the car.

SELLERS

Please have vehicle on premises at least one hour to schedule running time.  Late arrivals for reserved numbers will be run last.  A NO SHOW FEE of $25.00 per unit will be charged to all unused reserved premium numbers unless cancelled by 3:00pm Tuesday.  Vehicles that do not have proper VIN will not be registered for sale.  Vehicles which are unsafe to operate will not be run through the auction lanes.  Represent your cars accurately and fairly. 

REPRESENTATION OF CARS

If the car is not properly represented, file a complaint within one hour to arbitration office and get a decision before leaving.  All cars registered here are subject to inspection by the Alabama Bureau of Investigation, the Federal Bureau of Investigation, National Auto Theft Bureau, local police and auction inspectors.  Any car that does not have a warranty sticker or has a warranty sticker that does not match the VIN or has a mutilated or illegible warranty sticker must be check by the auction inspectors before it may be offered for sale.  Auction management reserves the right to void any transaction.

INTERPRETATION OF POLICY

IN MATTERS OF INTERPRETATION OF AUCTION POLICY, THE DECISION OF AUCTION MANAGEMENT SHALL BE FINAL.

ARBITRATION

  1. To Arbitrate a vehicle, vehicle must be on Deanco Property by close of business sale day 5:00 P.M. Central Standard Time.

  2. To Arbitrate a Vehicle, there must be no more than a maximum of 50 miles more than what is shown on Bill of Sale

  3. Any Price adjustment eliminates further arbitration for mechanical defects.

  4. Mechanical arbitration is day of sale only.

  5. Current year models only.  All paint work and major motor damage must be announced.  No visible defects on any model vehicle will be arbitrated.

  6. All "OUTSIDE SALES" are "AS IS" and are not subject to arbitration.

  7. The following type units must be announced and sold AS IS: Diesel conversions, municipal vehicles, taxi cabs, police cars, flood cars, frame damaged units, rebuilt units, cracked block units, salvage titles, recovered thefts, improper alteration, excessive body frame or roof damage (repaired or not).

  8. All units 10 years old or older are sold AS IS, unless green light is announced by the seller.

  9. Any unit unsafe to drive is unacceptable.

  10. Seller must announce all vehicles manufactured without air conditioning.

  11. Any single arbitratable item that exceeds $400 to repair as judged by auction mechanic is subject to arbitration.

  12. Arbitration on drive train only-engine, transmission, rear end, transaxle, motor, odometer and frame, steering and suspension not covered.

  13. Every effort will be made to make every sale final.  In the event a vehicle is rejected, it becomes the responsibility of the selling dealer.  The car may rerun immediately.  Under no circumstances does the auction inherit a vehicle.  The vehicle is not subject to arbitration unless repairs exceed $400.

  14. Auction is merely performing auction services for selling and purchasing dealer, and all transactions, which occur at auction, are transactions between selling and purchasing dealers, and auction is neither a buyer, seller, transferor nor transferee by reason of having provided auction services to such dealers. Auction does not provide any warranty or guarantee of any nature whatsoever not specifically set forth in this agreement including, but not limited to, warranties of merchantability or fitness for a particular purpose, and auction does not in any manner whatsoever warrant or guarantee the accuracy of odometers, odometer mileage statements, mechanical or physical condition, or prior history or use of any vehicle.  Buyer and seller agree to hold the auction harmless from any and all litigation that may arise from transactions at auction.

  15. If a dealer fails to pay for a vehicle purchased through auction, the auction will be allowed to sell the vehicle to mitigate its loss at wholesale or retail with a 10 day notice to a dealer or undersigned and the undersigned will be fully liable to auction for any deficiency, including incidental and consequential damages and expenses incurred by auction.

  16. Frame damage must be announced.  Discovery of frame damage or frame repair must be reported to  the auction within 7 days after purchase on all units.  Dealers document the persons name that you report the damage to as well as the day and time reported.  Any bolt on body parts are not considered part of frame.

  17. Items no arbitratable: tie down damage, "AS IS" units except as noted under rules for red light vehicles, C.V. joints, air conditioning, power accessories, radios, stereo systems, cruise control, brakes, convertible tops, dash gauges, electrical, excessive smoke.  Air bag deployment and or removal MUST BE ANNOUNCED.

**WARNING**

Sellers may be required to buy back any vehicle that auction management deems warranted.  Seller will be responsible for transportation expenses on "After Sale Say" arbitrations.

IF DEALS

  1. All "IF SALES" are binding until 5:00 p.m. of sale day unless otherwise requested.  If the seller has not accepted or rejected your bid by 5:00 p.m., you may then decline the vehicle,  If the seller accepts your bid, the car can only be returned pursuant to our arbitration policies.
  2. It is the responsibility of the buyer and seller to get in touch with the auction regarding acceptance of the bid.  Buyer and seller must provide the auction with correct contact information.
  3. Any transaction regarding "IF SALES" done after 5:00 p.m. on sale day is considered an "OUTSIDE DEAL" and CAN NOT be arbitrated.

 

SELLING LIGHT SYSTEM

   GREEN LIGHT - "SOUND"

        Selling dealer declares car is subject to all arbitration policies.

    YELLOW LIGHT - "CAUTION"

Selling dealer must announce any item subject to arbitration: These include but are not limited to, nonstandard motor and/ transmission, major exceptions to the original or advertised production specifications, items deleted or added, any unit in excess of 100,000 miles, true mileage unknown, or broken odometer.

    BLUE LIGHT - "NO TITLE PRESENT"

Assignable title does not accompany vehicle.  May require up to 30 days fro buyer to receive title.  The buyer is cautioned not to spend any money, drive excess miles, resell or damage the unit until title is received.  After a 30 day period, it is the buyer's option to return the vehicle after 30 days, special arrangements must be made with Deanco Auto Auction.  The office manager must be notified 24 hours prior to the return of the vehicle and arrangements must be made to return the vehicle during business hours.  If a buyer calls to return a vehicle for no title and Deanco Auto Auction has received or mailed the title, the buyer must keep the vehicle any expenses incurred by the buyer are the sole responsibility of the buyer.  The seller is responsible for all Deanco Auto Auction fees due to the transaction that involves a return vehicle.

RED LIGHT - "AS IS" FOR VEHICLES SELLING $2000 OR LESS

Buyer assumes total responsibilities for mechanical and physical defects with the following exceptions which the seller must announce:

  1. True mileage unknown, broken odometer, miles over.

  2. Rebuilt or assigned VIN numbers.

  3. Salvage or reconditioned titles even if current title is clear.

  4. Police Cars, taxis, boats, motorcycle, dune buggies, flood cars, kit vehicles, frame damage (repaired or not), hail damage, cracked block, antiques, boat motors, golf carts.

  5. Vehicles 10 years old or older.

  6. Odometer discrepancies must be announced.

  7. Do not rely on verbal statements made under the RED LIGHT.  These units are sold "AS-IS" with NO guarantees.

 

  • ALL DEALERS MUST HAVE BIDDER LABEL TO BUY AND/OR SELL.

  • Licensed Dealers Only

  • No Retail Customers

  • Any dealer bringing retail customers to the sale in subject to lose Auction privileges for an indefinite period of time.

  • ABANDONED VEHICLES WILL BE SOLD 30 DAYS AFTER NOTICE IS GIVEN TO LAST KNOWN OWNER.  $10.00 PER DAY STORAGE FEE APPLIES.
